Terms and Conditions – Social Media Giveaway

Please read these Terms and Conditions ("Agreement") carefully before participating in the social media giveaway ("Giveaway"). This Agreement sets forth the terms and conditions that govern your participation in the Giveaway organized by [KUDO] ("Organizer").

Eligibility:

1.1. The Giveaway is open to individuals who meet the requirements set by the social media platform on which the Giveaway is hosted (e.g., Instagram, Twitter, Facebook). Participants must comply with the platform's terms of service and community guidelines.

1.2. Employees, officers, directors, and immediate family members of the Organizer, its affiliates, subsidiaries, and advertising and promotion agencies are not eligible to participate.

Entry:

2.1. To enter the Giveaway, participants must follow the entry instructions provided in the Giveaway post on the designated social media platform (e.g., liking the post, commenting, sharing, tagging friends, etc.).

2.2. Only one entry per person is permitted unless otherwise specified in the Giveaway post. Multiple entries will result in disqualification.

2.3. By entering the Giveaway, participants warrant that all information provided is true, accurate, and complete.

Privacy and Data Collection:

3.1. By entering the Giveaway, participants acknowledge that the social media platform on which the Giveaway is hosted may collect, use, and disclose their personal information in accordance with its own privacy policy and terms of service.

3.2. The Organizer may collect and use participants' personal information, including but not limited to their username or handle, for the purposes of administering the Giveaway and contacting the winner(s). The Organizer will handle personal information in accordance with applicable data protection laws and its Privacy Policy, which can be found here.

Winner Selection and Prize:

4.1. The winner(s) will be selected randomly from all eligible entries received during the Giveaway period.

4.2. The Organizer will announce the winner(s) publicly on the social media platform where the Giveaway was hosted, and may also notify the winner(s) via direct message or email, if necessary.

4.3. The winner(s) must respond to the notification within the time specified by the Organizer to claim the prize. Failure to respond within the specified time will result in disqualification, and an alternate winner may be selected.

4.4. The prize(s) will be described in the Giveaway post and may be subject to additional terms and conditions or restrictions imposed by third-party providers or relevant authorities. The Organizer reserves the right to substitute the prize(s) with a prize(s) of equal or greater value if necessary.

Publicity:

5.1. By accepting a prize, the winner(s) agree to allow the Organizer to use their name, likeness, and any submitted content for promotional purposes on the Organizer's social media channels without further compensation or consent, unless prohibited by law.

Limitation of Liability:

6.1. The Organizer and its affiliates, subsidiaries, officers, directors, employees, and agents shall not be responsible for any loss, damage, injury, or claim caused in whole or in part, directly or indirectly, from participation in the Giveaway or the receipt, acceptance, or use of any prize.

6.2. The Organizer is not responsible for any typographical or other errors in the printing of this Agreement, the administration of the Giveaway, or in the announcement of the prize(s).

Modification or Termination:

7.1. The Organizer reserves the right to modify, suspend, or terminate the Giveaway, in whole or in part, at any time and without prior notice if it deems necessary or if circumstances arise beyond its control.

7.2. The Organizer reserves the right to disqualify any participant found to be violating the terms of the social media platform, tampering with the entry process, or violating this Agreement.

Governing Law and Jurisdiction:

8.1. This Agreement shall be governed by and construed in accordance with the laws of [CANADA]. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of [CANADA]. By participating in the Giveaway, you acknowledge that you have read and understood this Agreement and agree to be bound by its terms and conditions.
